The UFC Hall Of Fame member, who both survived the ordeal and will have to deal with lifelong medical issues due to the accident, has filed a lawsuit against the train operator (Norfolk Southern Railway) and several of their employees according to MMA Fighting. The suit, which was filed this past June in Montgomery County (illinois) alleges that Norfolk Southern Railway and their employees were negligent in failing to warn drivers of the dangerous conditions near the railroad where the accident happened at.
Audra Hughes, who is current entangled in a legal battle with her husband, is named as a co-plaintiff in the lawsuit.
Hughes? attorney alleges in the suit that Norfolk Southern Railway didn?t post adequate warning signs at the crossing and the location poses a great danger to the general public. The estranged husband and wife are seeking $50,000 each, as well as attorney costs and other forms of relief as allowed by the courts.
Norfolk Southern Railway has denied the allegations against them and are claiming that Hughes had failed to stop his truck at a safe distance before the accident had occurred. Norfolk Southern Railway also says that there are proper warning signs in place near the crossing.
Attorney?s for Norfolk Southern Railway have already filed motions to have the case dismissed, but no ruling has been made on that motion at this time.
