Update On Class Action Lawsuit Against WWE Claiming Fans Were Misled About PLE Access On ESPN

In January, a class action lawsuit was filed against WWE, accusing the company of deceptive marketing practices regarding PLE access on ESPN Unlimited.

The lawsuit argued that some fans who already get ESPN channels through cable or other providers were still required to pay an additional monthly fee to watch WWE events. The plaintiffs allege this contradicts marketing communications from both WWE and ESPN, which they claim suggested all existing ESPN subscribers would have access to the PLEs.

The latest filing (via Brandon Thurston of POST Wrestling) from the plaintiffs asks that discovery not be stayed as they argue WE can’t be trusted to preserve evidence, pointing to recent ruling against Nick Khan for destroying evidence.

Vince McMahon and Nick Khan were sanctioned in the merger lawsuit against the company for destroying evidence.

The company has been asking the court to put discovery on hold because they want to compel arbitration, citing the arbitration clause in the ESPN streaming user agreement.

ESPN filed a motion to intervene in March.
