WWE motion to compel arbitration is granted.
On May 9, Judge Mark T. Pittman ruled that WWE's motion to compel arbitration in the lawsuit against them presented by Marvin Jackson over an injury suffered at WrestleMania 38 had been granted. The case was dismissed with prejudice.
Jackson sued WWE over loss of hearing from the sound of pyro at the event. WWE filed a motion asking that the situation be moved to arbitration, arguing that fans had to check boxes before buying tickets online and agreeing to the terms and provisions, which included agreements to enter arbitration over legal issues.
Jackson had asked the court to deny the motion for arbitration, stating that his nephew got the tickets and that he had neither accepted nor was bound by the terms & conditions put forth by WWE.

CONCLUSION
Because the Court finds that Jackson is subject to the Arbitration Agreement and there is no real dispute by Jackson’s injury falls within the Arbitration Agreement's scope, WWE’s motion to compel arbitration is GRANTED.1 This action is DISMISSED WITH PREJUDICE in favor of arbitral proceedings to be instituted by Jackson against WWE, as provided for in their Arbitration Agreement. See Alford v. Dean Witter Reynolds, Inc., 975 F.2d 1161, 1164 (5th Cir. 1992) (upholding dismissal with prejudice of claims when all the party's claims were subject to arbitration). A final judgment will issue by separate order.
