Dr. Colker and his practice suit are targeting the firm and Ann Callis.
Physician and celebrity doctor Carlon M. Colker and his practice are seeking a default win in Connecticut federal court. Per a motion (via Law360), they are looking for a victory against an alleged nonresponsive law firm over comments a partner made amid a discovery dispute that is connected to former WWE employee Janel Grant's sex trafficking lawsuit against WWE and Vince McMahon.
Colker and Greenwich-based Peak Wellness Inc. are motioning for a clerk's default, which is when a court clerk officially records that a defendant has failed to respond or participate in the case within a specific timeframe. Colker and his practice are saying that Holland Law Firm LLC has yet to respond to their complaint from May 2nd or anything else, despite being notified about it.
The suit is targeting the firm and attorney Ann Callis, who is representing Janel Grant in her suit against WWE, Vince McMahon, and formerly John Laurinaitis. Laurinaitis was dropped from the suit after agreeing to cooperate and provide evidence against Vince and WWE. It is alleged that Callis made defamatory comments during an October 2024 press conference. Colker and Peak Wellness Inc. claim Callis accused them of not sticking to medical and ethical standards while treating Janel Grant.
Per Grant's suit, she went to Colker for help with physical and emotional damage that was done by Vince McMahon. She noted that McMahon and WWE paid tens of thousands in medical expenses.
On the same day that Holland Law Firm was notified about Colker and Peak Wellness' complaint, Connecticut Superior Court Judge Colleen Zingaro denied a motion to dismiss Grant's suit for a bill of discovery. The judge learned that she established that the information she was seeking may support state-level causes of action against Colker and Peak Wellness, including various conspiracy counts and actively helping commit fraudulent acts.
During the aforementioned press conference in October 2024, Callis said Colker instructed Grant to take "mystery pills" and provided her with treatments of "unknown contents." Those were remarks that Colker and his practice called "demonstrably false." Here's a passage from their suit:
Since issuing her false, malicious, and defamatory statements, numerous media outlets and public figures have amplified Callis's statements, significantly exacerbating the damage to plaintiffs' reputations. Callis's false statements have been viewed, shared, and discussed by millions of individuals worldwide, including prospective patients, professional colleagues, and potential jurors.
Law 360 reached out to representation for Colker/Peak Wellness and reps for Holland Law firm, but neither responded.
Colker and Peak Wellness are represented by Dennis M. Durao of Karsten & Tallberg LLC, and Alejandro Brito and Lara Juliette Fernandez of Brito PLLC.
